I/we understand that in the event of a default being reported to TICA DEFAULT TENANCY DATBASE or any other tenancy database, the removal of such information is subject to the guidelines of the database companies.

  • I/We agree that upon communication of acceptance of this application by the landlord or his agent that this tenancy shall be binding on both the landlord and the tenant. I/We further agree that I/We will sign the Tenancy Agreement, and be bound by the terms and conditions of the Tenancy Agreement.
H. PRIVACY ACT ACKNOWLEDGEMENT
This form provides information about how we the below named agent handle your personal information, as required by the National Privacy Principles in the Privacy Act 1988, and seeks your consent to disclosures to the TICA Group of companies (TICA) in specified circumstances. If you do not consent to the disclosure of your personal information to TICA we can not process your application.
Primary Purpose
Before a tenancy is accepted we collect your information to assess the risk to our clients in providing you with a property you have requested to rent and if considered acceptable provide you with a tenancy for the property. In order to assess your application we disclose your personal information to

  • The Lessor / Owners for approval or rejection of your application.
  • TICA Default Tenancy Control Pty Ltd and TICA Assist Pty Ltd to assess the risk to our clients and verify the details provided in your tenancy application.
  • Referees to validate information supplied in your application
  • Other Real Estate Agents to assess the risk to our clients.
We may also take into account any information that is disclosed to us by TICA relating to attempts by Debt Collection Agencies and related person to contact or locate you.
Secondary Purpose
During and after the tenancy we may disclose your personal information to

  • Tradespeople to contact you for repairs and maintenance of the property.
  • Tribunals or Courts having jurisdiction seeking orders or remedies.
  • Debt Collection Agencies and related persons to permit them to contact or locate you.
  • TICA Default Tenancy Control Pty Ltd to record details of your tenancy history.
  • Lessors / Owners insurer in the event of an insurance claim.
  • Future rental references to other asset managers / owners.
If you fail to provide your personal information and do not consent to the uses set out above we cannot properly assess the risk to our client or carry out our duties as an asset manager. Consequently we cannot provide you with the property you requested to rent.
TICA Statement
As the TICA Group may collect personal information about you, the following information about the TICA Group is provided in accordance with the National Privacy Principles in the Privacy Act 1988. TICA Default Tenancy Control Pty Ltd (ABN 84 087 400 379) is a tenancy database that records tenants personal information from its members including tenancy application inquiries and tenancy history. TICA Assist Pty Ltd (ABN 28137 488 503) is a database company that records information from mercantile agents and associated industries. In accordance with the National Privacy Principles you are entitled to have access to any personal information that we may hold on any of our databases. To obtain your information from the TICA Group proof of identity will be required and can be made by any of the following ways.

Primary Purpose
The TICA Group collects information from its members and provides such information to other members as a risk management system for the purpose of assessing a tenancy application. The TICA Group does not provide any information that it collects to any other individual or organization other than its own group of companies for any other purpose other than assessing a tenancy application or risk management system or locating system other than government departments and or agencies allowed by law to obtain information from the TICA Group.
The personal information that the TICA Group may hold is as follows
Name, date of birth, drivers license number, proof of age card number and or passport number (except Australian) and address at time of making a tenancy application, comments made by a TICA member in relation to your tenancy, which members you rented through and which members you applied to and which members are seeking you.

If you're personal information is not provided to The TICA Group the member may not proceed with assessing your application and you may not be provided with the rental property.
I. SPECIAL CONDITIONS
  • The tenant acknowledges that the carpets will be cleaned by a professional contractor nominated by the agent at the expiration of this tenancy agreement at the tenant's expense (clause 2.9 refers). If the tenants use a contractor other than the one the agent recommends, and the carpet is not cleaned to the agent's satisfaction, the carpets may be cleaned again by a contractor nominated by the agent at the tenant's expense.
  • The owner or agent accepts no liability for television points. Should the tenant wish to use them then any adjustment required to suit their television set will be a t the tenant's expense.
  • No posters, nails, stickers, screws, poster putty, blue tac, adhesive tape or fittings to be fixed to the walls, windows, doors and ceilings.
  • The tenant is responsible for re-lighting of pilot lights in gas hot water systems due to wind; all batteries in smoke alarms and replacement of light globes when required.
  • The tenant understands that under clause 2.16 of the tenancy agreement they are to maintain the lawn and garden areas of the property to water and fertilise them regularly and adequately, to remove weeds, and the lawn areas to be mowed on a regular basis.
  • The tenant and visitors understand that parking is not allowed on the grassed areas of the property. In addition tenant and visitors' cars must not obstruct any common driveway or access way of the property.
  • The tenant agrees that should they need to use the Agents keys to access the property during working hours they must collect the keys from the office and return the same keys to the office by close of business that day. Should the tenant require the office keys outside normal business hours and/or require the Agent to deliver the keys to the tenant then the tenant understands and agrees to pay the charge of $80.00 per time. The tenant is aware that should the Agent be unable to attend, the tenant agrees to pay all costs associated with gaining access to the property.
  • The tenant is aware that smoking is not permitted inside the property.
  • The tenant shall not keep any animal or bird or fish on or about the premises without prior written permission of the Owner (2.19).
  • The tenant is aware that inspections will be carried out every three months; the first inspection will be scheduled six (6) weeks from the commencement of the tenancy. The agent will give not less than seven (7) days or no more that fourteen (14) days notice in writing. If the tenant cannot be available to attend the inspection, the agent has the right to enter the property providing the required notice has been give.
  • Change of occupation: the tenant agrees to notify the landlord or agent within 14 days of any new place of occupation (Section 53 (2) Residential Tenancy Act Penalty $100).
  • The tenant agrees to notify the landlord or agent in writing no less than twenty-one (21) days prior to the expiration of this agreement that he/she will be vacating the property.
  • Rent from bond money: The tenant acknowledges that: - a tenant shall not fail or refuse to pay any rent due under an agreement with the intention that the amount of such rent be recovered by the owner from the security bond paid by the tenant (Section 52 of the Residential Tenancy Act Penalty $1,000).
  • The tenant agrees to clean the carpets during the tenancy if requested by the agent.
  • The tenant agrees that if the property is fitted with an air conditioning unit/s, the filters of all unit/s must be cleaned on a regular basis and at the end of the tenancy.
  • The tenant agrees that if the property is fitted with a dishwasher, that a de scaling treatment must be administered on a regular basis and at the end of the tenancy.
